8(a) Sole Source

The Small Business Administration (SBA) 8(a) Sole Source vehicle enables agencies to engage in direct buy contracts with certified contractors. Professional Management Enterprises Inc,’s SBA 8(a) and Small Disadvantaged Business (SDB) certification is valid through July 2019.


Section 8(a) of the Small Business Act as amended by Congress, created the 8(a) business development program. This program enables SBA to assist small disadvantaged firms to develop their businesses. In applying to the program, a firm is rigorously evaluated on its ownership, operations, financial health, and past performance. Once accepted, the firm is required to provide SBA a detailed business plan and annually show continued success as a viable, strong business entity. Firms that are approved are certified by the SBA for a period of nine years. The SBA has signed Memorandums of Understanding (MOUs) with Federal Agencies allowing them to contract directly with certified 8(a) firms. Participants can receive sole source contracts, up to a ceiling of $4 million for goods and services.


The 8(a) sole source vehicle provides agencies a simplified and shortened acquisition procedure:

* Reduced decision cycle: time required to award an 8(a) sole source contract is usually within days.

* Lowered administrative costs: procurement process and time is reduced to a minimum.

* Prices reflecting the best value: agency negotiates with the firm directly to get the best value.

* Credit for promoting small business participation within agency.

* Can initiate a contract with a simple high level statement of work.

Professional Management Enterprises Inc. is a Service Disabled Veteran Owned Small Business (SDVOSB) and is eligible for directed SDVOSB awards and set-aside. The procurement is covered under: Subpart 19.14—Service-Disabled Veteran-Owned Small Business Procurement Program ( 19_14.html) In general the law states:

19.1401 General:

1. The Veterans Benefit Act of 2003 (15 U.S.C. 657f) created the procurement program for small business concerns owned and controlled by service-disabled veterans (commonly referred to as the “Service-Disabled Veteran-owned Small Business (SDVOSB) Procurement Program”).

2. The purpose of the Service-Disabled Veteran-Owned Small Business Program is to provide Federal contracting assistance to service-disabled veteran-owned small business concerns.

19.1406 Sole source awards to service-disabled veteran-owned small business concerns. A contracting officer may award contracts to service-disabled veteran-owned small business concerns on a sole source basis (see 19.501(d) and 6.302-5), provided:

1. Only one service-disabled veteran-owned small business concern can satisfy the requirement

2. The anticipated award price of the contract (including options) will not exceed:

a. $5.5 million for a requirement within the NAICS codes for manufacturing; or

b. $3 million for a requirement within any other NAICS code

3. The service-disabled veteran-owned small business concern has been determined to be a responsible contractor with respect to performance; and

4. Award can be made at a fair and reasonable price.
